A Federal high court in Kano has awarded 10 million naira compensation to Emir Aminu Ado Bayero against Kano state government for allegedly ordering his arrest and eviction from the Nasarawa Mini palace.
Justice Simon Amobeda delivered the judgement in a fundamental right enforcement suit filed by the deposed emir.
The court held that it has jurisdiction to hear and entertain the matter being fundamental right enforcement application, averring that Ado Bayero has the liberty and legal right to move freely and live anywhere in Kano or elsewhere in Nigeria.
The court, however, declined to order eviction of the reinstated emir Muhammad Sanusi from the Gidan Rumfa palace as sought for in the application.
Counsel for Kano state government and emir Sanusi, Ibrahim Isa Wangida said the judgement is a victory for the emir and his admirers as the court did not void the law that warranted Sanusi’s reinstatement, Daily Trust reports.
He said he will consult his client on whether or not they will appeal the award of ten million naira against them.
Counsel for Aminu Ado Bayero, Abdulrazaq Ahmad said his position was vindicated by the judgement that the court has inherent powers to hear and determine the case and that the fundamental rights of his client were breached or about to be breached.
He said the judgement has restrained the state government or any security agencies from breaching the rights of the emir.
